Report: Alcohol in Lindsay Lohan's Car at Time of Crash

Amy Graves/WireImage(LOS ANGELES) -- There was an open container of alcohol in the Porsche Lindsay Lohan was driving when it struck a dump truck near Los Angeles last Friday, but it appears she was not under the influence at the time. reports police at the scene found a plastic water bottle containing alcohol that had been in the Porsche.  One source says the bottle was found in the trunk of the car, while another says it was found nearby the vehicle.  It is not illegal to keep an open container of alcohol in the trunk of a car.

According to TMZ, police say Lohan did not have alcohol in her system at the time of the crash.

Earlier this week, TMZ reported that the Mean Girls star may have violated her informal probation by falsely claiming to police that her assistant was the driver of the Porsche.

Underage "Hunger Games" Star Allegedly Buys Whiskey with Fake ID

Kevin Winter/Getty Images(LOS ANGELES) -- Josh Hutcherson, the 19-year-old star of The Hunger Games, has been photographed leaving a Los Angeles grocery store with a bottle of alcohol, reports TMZ.

The actor, who plays Peeta Mellark in the hit movie, allegedly used a fake ID to obtain the bottle of Macallan Whiskey. Just a few weeks ago, Josh spoke on camera to TMZ saying, “I think the age to go to war is 18…so I think the drinking age should be 18 as well.” A representative for Hutcherson has not commented on the matter.

A spokesperson for the grocery chain, Ralphs, told TMZ, “We strictly enforce all laws relating to the sale of alcohol to minors. We will investigate these allegations and take any steps necessary.”

Exclusive: Leslie Carter Overdosed

Michael Tran/FilmMagic(NEW YORK) -- Leslie Carter suffered from an overdose and was under the influence of several drugs before her death, according to the incident report from New York officials who responded to a 911 call from her home on Tuesday.

The report lists three drugs that were found at the residence: Olanzapine, used to treat the symptoms of schizophrenia, Cyclobenzaprine, a muscle relaxant, and Alprazolam used to treat anxiety or panic disorders, commonly known as Xanax.

The report reveals that Ginger Carter, Leslie's half-sister, told authorities that Leslie had, "a long history of mental illness and was on medication for her depression." Ginger said that Leslie seemed depressed the morning of Jan. 30 and fell in the shower. Ginger helped Leslie lie down and periodically checked in on her. Late in the afternoon, she discovered that Leslie was not breathing. Robert Carter, Leslie's father, tried to perform CPR on her. They then called 911.

Leslie's official cause of death will be determined after the Chautauqua County coroner's office receives toxicology reports in four to six weeks. Her family will decide whether or not to release her cause of death publicly.

Meanwhile, preparations for her funeral are underway. She will be buried in western New York next week, coroner Richard Mackowiak told ABC News.

Carter, the sister of Backstreet Boy band member Nick Carter and singer Aaron Carter, died Tuesday in New York. She was 25. She leaves behind her husband of three years, Mike Ashton, and a 10-month-old daughter, Allysa Jane.

'No Illegal Substances' Found in Amy Winehouse's System

Samir Hussein/Getty Images(LONDON) -- Whatever caused Amy Winehouse's death, it wasn't illegal drugs.

The BBC reports that according to Winehouse's family, toxicology results show that "no illegal substances" were found in the singer's system at the time of her death.  Alcohol was present, but it's unclear if it played a role in her death.

The BBC reports that Winehouse's family thanked the police for their work, and said that they are awaiting the results of the inquest into her death on October 26.

Winehouse was found dead in her London home on July 23.

Lindsay Lohan: Rumors of Me Falling Down Drunk Are 'Absurd'

Stephen Dunn/Getty Images(LOS ANGELES) -- Lindsay Lohan has put her foot down about rumors that she left a friend’s party on Saturday falling-down drunk. reports that Lindsay said, "Reports of me being intoxicated and not even able to stand are nothing but absurd." Lindsay went on to say that she didn’t even drink at the birthday bash for her friend at the Palihouse hotel in Los Angeles, Calif. One of Lindsay’s friends has got her back too, saying, "Lindsay walked out of the party fine and she never once couldn't stand up by herself.  It's strange how someone can come up with such detailed lies."

Paris Hilton's Brother Ordered to Pay $4.9 million in DUI Case

Marcel Thomas/FilmMagic(LOS ANGELES) -- Paris Hilton's younger brother Barron Hilton has been ordered by Los Angeles County Superior Court to pay $4.9 million to a former gas station attendant he struck with his Mercedes-Benz in 2008, according to the Los Angeles Times.

Mr. Hilton, who was 18 at the time of the incident, was sued by Fernando Tellez, a gas station attendant working at a station on the Pacific Coast Highway.  Eyewitnesses said Barron allegedly drove in the wrong direction for miles down the highway and struck Tellez with his vehicle when he pulled into the station.

Hilton's blood-alcohol level was a .14 percent and he was arrested and charged with driving under the influence of alcohol and drugs.  Barron later pleaded no contest to the charges.

Tellez's attorney, Joseph M. Kar, claimed his client suffered "permanent disability" and was forced to "undergo multiple surgeries and medical procedures" as a result of the accident.  Kar added that the accident “destroyed” Tellez’s family and “his ability to provide for his family.”

Snooki's Ex Upset about Her Dance with Potted Plant

Jason Merritt/Getty Images(NEW YORK) -- Nicole "Snooki" Polizzi’s ex-boyfriend Emilio Masella is lashing out at MTV’s Jersey Shore producers for "turning Nicole into an alcoholic."

Masella, who dated Snooki for two months last year, was not happy about her alcohol-infused, plant-dance video that recently made the rounds online.  The clip shows a visibly intoxicated Snooki dancing with a potted plant.

He tweeted, "This is Disgusting. MTV's Jersey Shore is turning Nicole into an Alcoholic. They are killin her liver. That's not the nicole I knew! Poor girl."

However, Masella stopped short of blaming the Jersey Shore cast member for her own bad behavior, writing, "The Vid on TMZ with Nicole Dancing with the plant, is a total embarrassment. I blame Production."

"They won't learn till she hurts herself," he added.

Snooki has already come close to injury while intoxicated.  Last season, she did a face plant on a New Jersey beach and was subsequently arrested.

Daniel Radcliffe Reveals Past Alcohol Issues

ABC/Lou Rocco(NEW YORK) -- The star of the Harry Potter films, Daniel Radcliffe, says he's stopped drinking because he was enjoying it a bit too much.

Radcliffe tells GQ magazine that he made the decision to give up drinking altogether two years ago as soon as he realized how much he depended on it.

“I became so reliant on [alcohol] to enjoy stuff,” Radcliffe told the magazine.

“There were a few years there when I was just so enamored with the idea of living some sort of famous person's lifestyle that really isn't suited to me," he added.

Radcliffe, who's been busy on Broadway starring in How to Succeed in Business Without Really Trying, says he's content with his new life path.

"As much as I would love to be a person that goes to parties and has a couple of drinks and has a nice time, that doesn't work for me,” said the actor.  “I'd just rather sit at home and read, or go out to dinner with someone, or talk to someone I love, or talk to somebody that makes me laugh."

The final Harry Potter film -- Harry Potter and the Deathly Hallows, Part 2 -- hits theaters July 15.

Lindsay Lohan Escapes Jail Time, Can Legally Drink Again

AL SEIB/AFP/Getty Images(LOS ANGELES) -- Lindsay Lohan has escaped jail time again, and now she's officially allowed to drink alcohol.

At a Los Angeles Superior Court hearing Thursday, Judge Stephanie Sautner ruled that the actress did not violate her probation stemming from her 2007 DUI case because there was no order in place to test her for drugs and alcohol.

But Sautner ordered Lohan, who was in court because she failed an alcohol test last week, not to have parties and not have more than one friend at her house at a time. She also told the problem-prone star not to do "stupid" things that fly in the face of the court's order.

Sautner said Lohan was guilty of "extremely poor judgment by having roof parties while on home confinement" before adding, "poor judgment is not a violation of your probation." Lohan threw a rooftop barbeque for her friends last week.

Prosecutors asked to reinstate mandatory drug and alcohol testing; Sautner declined the request.

The decision came after more than an hour of deliberations between Lohan's legal team and prosecutors in Sautner's chambers. The actress arrived for her 10 a.m. PT hearing in a conservative outfit -- black slacks, black shoes, a button down shirt, her blonde hair pulled back -- a departure from her more revealing recent courtroom attire.

Lohan was ordered to court after she failed an alcohol test last week. The L.A. County probation department was under the impression that she was required to take drug and alcohol tests, but upon a closer reading of Lohan's old probation order Thursday, the testing requirement was deemed expired.

That means that technically, Lohan can drink alcohol.

The hearing came as Lohan wraps up her house arrest stint for taking a $2,500 necklace from a Venice, Calif., jewelry store. She's due to be released from house arrest Wednesday.

Ryan Dunn's Blood Alcohol Level Well Over Limit

J. Strauss/FilmMagic(WEST GOSHEN, Pa.) -- Jackass co-star Ryan Dunn's blood alcohol level was well over the legal limit, according to West Goshen, Pa., police who released the results of a toxicology test Wednesday.

According to a press release obtained by ABC News from the West Goshen Police Department, the county coroner determined that Dunn had a blood alcohol concentration of .196 -- more than twice the legal limit in Pennsylvania -- at the time of his death in a fiery car crash.

In 2003, the state lowered the limit from .10 to .08 and created three levels of DUI. The highest level offender is considered to have a blood alcohol level of .16 and higher.

The coroner did not detect any "drugs of abuse," the release said.

Both Dunn, 34, and his passenger, Zachary Hartwell, 30, died in the accident in the early morning hours of June 19 when his 2007 Porsche crashed in West Goshen.

Dunn's car was found in a wooded area off the road engulfed in flames.

The initial police investigation indicated that Dunn was traveling at a speed between 132 and 140 at the time of his crash. Police also say Dunn possessed a valid driver's license.

Dunn's Porsche jumped a guardrail, flew through 40 yards of trees and burst into flames, killing both Dunn and Hartwell instantly.

The Philadelphia Inquirer reported that Dunn had received at least 23 driving citations, including 10 for speeding and careless driving, in the 13 years before his fatal car accident. According to records obtained by the Inquirer, Dunn was arrested for DUI in 2005. Charges were dropped after he completed a probationary program. His license was also suspended for more than a year.

Dunn had posted a photo online just hours before the crash that showed him and two friends drinking at a local bar, Barnaby's, in West Chester. Friends said he had six drinks before getting in his car.
