Son of “Real Housewives of Miami” Star Charged in Homeless Attack

ABC News(NEW YORK ) -- The son of a Real Housewives of Miami star plans to plead not guilty to charges of simple battery for allegedly assaulting a homeless man, his lawyer said.

Peter Rosello, son of Real Housewives of Miami star Alexia Echevarria, was charged with simple battery with prejudice Wednesday, according to Miami Beach police. Due to hate crime law, his charges are a felony instead of a misdemeanor because the victim is homeless.

Rosello, of Miami Beach, Fla., turned himself in to police Wednesday and was released on $5,000 bond.

Police discovered a YouTube video Oct. 3 showing the 20-year-old saying, "Going to punch a hobo," before punching a sleeping man in the groin and running away.

"They don't know my son. My son has a huge heart," Echevarria told ABC affiliate WPLG. "He's just a good kid who made the wrong choice at that time."

Rosello's attorney, Richard Sharpstein, said he has yet to speak to the prosecutor but he told ABC News Rosello's case could be affected by his mother's celebrity status.

"I think it's affected the case already in the sense that it's gotten a little bit more attention than it might have otherwise," he told ABC News.

Echevarria expressed her son's remorse to WPLG.

"He's very sad about this, and, hopefully, we'll get through it, all the family, because everything else I have going on in my life," Echevarria told WPLG.

Miami Beach police reached out to the city's Homeless Outreach Teams who identified the homeless man to police as Gary Lee Brown. Brown, 62, told police the 20-year-old assaulted him for no apparent reason and he wanted to press charges.

Echevarria, who is the executive editor of Venue Magazine, said "any mother could identify" with the situation and she knows her status as a reality star has had an effect on it.

"You never think about this side and how unfortunate it is and how people -- the humanity -- they have this hate inside their heart," Echevarria told WPLG. "They like this -- they like to see other families suffering. To me, that's the saddest think of this whole situation."

Echevarria's Real Housewives of Miami bio on Bravo's website says the star "admits she is at times more of an older sister than a disciplinarian to her two sons from a previous marriage." The Real Housewives of Miami is in its second season.

Rosello's arraignment hearing is set for Nov. 9.

John Travolta Sued by Cruise Ship Worker

Ryan Pierse/Getty Images(LOS ANGELES) -- A Chilean cruise ship employee named Fabian Zanzi has filed a lawsuit claiming John Travolta made sexual advances at him, according to E! Online.  He says in a 16-page lawsuit that the incident occurred during a Royal Caribbean cruise in June 2009.

Zanzi says he was delivering room service to the actor when Travolta complained of neck pain.  Zanzi alleges in court papers that when he reached for Travolta's robe, the actor instead removed the robe and "proceeded to forcefully embrace" Zanzi while naked. 

Zanzi claims that he "pleaded" with Travolta to release him from the embrace.  He alleges Travola’s conduct was "nonconsensual, inappropriate, extreme and outrageous."

Travolta's attorney, Marty Singer, responded to the suit in a statement to E! News, saying, "This is another ludicrous lawsuit with inane claims.  It is obvious that Mr. Zanzi and his lawyers are looking for their 15 minutes of fame."

Zanzi also alleges that Travolta offered him $12,000 for his silence about the incident.  However, Zanzi says he reported the incident to "at least three" superiors at Royal Caribbean. 

Zanzi is asking for unspecified damages for assault and battery and intentional and negligent infliction of emotional distress.

An attorney for Travolta, who has been married to actress Kelly Preston since 1991, noted, "We are confident that my client will prevail on the merits and that he will be completely vindicated in court."

Two masseurs sued Travolta earlier this year, claiming sexual battery and sexual harassment, but later dropped their complaints.

Lane Garrison Charged with Misdemeanor Battery

David Livingston/Getty Images for Sofitel(LOS ANGELES) -- Actor Lane Garrison was charged with one count of misdemeanor battery on Thursday for allegedly slapping his ex-girlfriend in the lobby of her Beverly Hills apartment on Saturday, according to the Los Angeles District Attorney’s Office.

The charge comes after a witness came forward saying they witnessed the altercation between Ashley Mattingly and the former Prison Break star.  It also comes after Garrison maintained that surveillance footage of the incident was "misleading" and that the 31-year-old actor was simply trying to get his cellphone back.

Garrison will head to a Beverly Hills court on Friday to be arraigned.  He is currently being held without bail because this latest charge violates his parole.  The actor is on parole for a 2007 vehicular manslaughter conviction.

If convicted, Garrison faces up to one year in jail and a $2,000 fine.

Actor Tom Sizemore Arrested

Jerod Harris/WireImage(LOS ANGELES) --  Saving Private Ryan’s Tom Sizemore might need some saving of his own.

The 49-year-old actor was arrested in Los Angeles, Calif., Monday night after cops at his apartment complex discovered that there was an outstanding warrant on him for battery. Sizemore is currently being held on $26,000 bail.

Sizemore has been arrested three times on battery and drug related charges.

'NCIS' Actor Arrested for Allegedly Attacking Neighbor

Digital Vision/Photodisc/Thinkstock(LOS ANGELES) -- David Fisher, who plays CIA operative Trent Kort on the CBS hit NCIS, was arrested Thursday in Los Angeles after he allegedly choked a neighbor, reports.

The alleged incident occurred during a dispute over the neighbor hanging towels outside.  The neighbor was taken to a hospital, but TMZ does not state his current condition.

Fisher was arrested on suspicion of felony battery.  He was in jail as of Thursday night in lieu of $50,000 bail.

Mel Gibson Booked at California Police Station over Battery Case

Michael Kovac/FilmMagic(LOS ANGELES) -- Mel Gibson had a good excuse for missing the premiere of his new movie, The Beaver, on Wednesday night: he was turning himself in to police in connection with the alleged confrontation he had in his home last year with his then-girlfriend, Oksana Grigorieva.

According to The Hollywood Reporter, the 55-year-old actor was fingerprinted and had his mug shot taken at El Segundo Police Department in California.  A sergeant with the department tells The Hollywood Reporter, "He was very pleasant...We did it real quick and he was out."

Gibson was booked as part of the plea deal he reached last week in the case, when he was placed on three years' probation after pleading no contest to misdemeanor spousal battery.  He must also undergo one year of domestic violence counseling and perform 16 hours of community service.

Gibson had been accused of hitting Grigorieva at his Malibu, California home in January of 2010.

Gibson's new film, The Beaver, premiered at the South by Southwest festival in Austin, Texas on Wednesday night.  It opens nationwide in May.

Lindsay Lohan Investigated for Battery

Photo Courtesy - AL SEIB/AFP/Getty Images(RANCHO MIRAGE, Calif.) -- It sounds like Lindsay Lohan may be squeezing a few more drops of drama out what has already been a drama-filled 2010.

Authorities are investigating the Mean Girls star for alleged misdemeanor battery against a female employee at the Betty Ford Clinic, reports  Lohan has been staying at Betty Ford since September.

An official with the Riverside County Sheriff's Department in California says officers responded to a call on Dec. 12.  Lohan claims the staffer was "unfairly" chastising her when she arrived at the facility 10 minutes after her curfew.  When the staffer demanded Lohan take a drug test, the two got into a testy war of words, at which point the worker "put her hands on Lindsay."

Lohan says she ordered the woman to "take your hands off of me" before she shoved the employee.  The staffer now wants to press charges against Lohan for criminal battery.  Lohan claims the worker has had it in for her for some time.

Lohan is scheduled to remain in Betty Ford until January 3.
