Linda Evangelista Settles Child Custody Case

Rabbani and Solimene Photography/Getty Images for Versace for H&M(NEW YORK) -- Supermodel Linda Evangelista, 46, has reached a settlement in her child custody case against her son's father, French billionaire Francois-Henri Pinault, 49, ABC News has learned.

Court was adjourned Monday afternoon after the attorneys for both sides met in the judge's chambers. No details of the settlement were announced, but the parties are expected to be called back to court Tuesday to approve details of the settlement in writing.

According to the New York Post, Evangelista and Pinault reached an agreement by telephone earlier in the morning.

Evangelista was reportedly asking for upward of $46,000 in monthly expenses for their 5-year-old son Augustin (also known as Augie), and though she denied such a figure in court last Thursday, no additional figure has been floated.

The settlement came as media from around the world flocked to Manhattan Family Court to hear the supermodel's second day of testimony. Evangelista had been expected to testify about Pinault's initial reluctance that she have the child. Her defense team had earlier claimed that Pinault asked her to terminate her pregnancy.

Though Pinault had known he was Augie's father since January 2007, he did not recognize Augie as his son until 2009 after his now wife, actress Salma Hayek, had given birth to their daughter Valentina. When asked the reason for his clandestineness, Pinault admitted that he had been more concerned with Valentina at the time. They had thought for five months that Valentina had Down's syndrome and Pinault professed in court that "we almost lost the baby."

Evangelista had been riled for making wild demands, including 24-hour child care and a bodyguard for Augie, with critics questioning if these expenses were not just means to gain funds for herself under the guise of child support.

Pinault is the chief executive of PPR, his family's company that owns such luxury brands as Gucci and Yves Saint Laurent. Heir to the $11.5 billion empire, Pinault brings in $4 million to $5 million annually.

Evangelista, a mogul in her own right, is the former face of L'Oreal Paris and has graced the cover of over 600 magazine covers. She is reportedly worth $8 million.

Supermodel Linda Evangelista, French Tycoon Duke it Out Over Child Support

Rob Kim/Getty Images(NEW YORK) -- In the second day of the battle of the malcontent millionaires, Linda Evangelista, 46, duked it out, litigation-style, with her former lover Francois Henri-Pinault, 49, on Friday over how much money she would receive in monthly expenses for their 5-year-old son, Augustin.

Evangelista was reportedly asking for upward of $46,000 in monthly expenses for Augustin (also known as Augie), and though she denied such a figure in court on Thursday, no additional figure has been floated.

David Aronson, Pinault’s attorney, argued in a New York family court that the issue is wholly  moot, contending that Pinault initially reached out to Evangelista and her former lawyer, Francois Chateau, in 2007 asking for a decision regarding child support. He says that the letter was met with no response. A letter sent from Pinault’s attorneys to Chateau reads, “Dear Francois, your silence is deafening… we owe it to our clients to conclude this matter.”

“When I make an offer, if there is not an answer, that means no,” said Pinault in court on Friday.

Though Pinault had known he was Augie’s father since January 2007, he did not recognize Augie as his son until 2009 after actress Salma Hayek had given birth to their daughter Valentina. When asked the reason for his clandestineness, Pinault admitted that he had been more concerned with Valentina at the time. They had thought for five months that Valentina had Down’s Syndrome and Pinault professed in court that “we almost lost the baby.”

Evangelista has been riled for asking for wild demands including a 24 hour nanny and bodyguard for Augie, with critics questioning if these expenses were not just means to gain funds for herself under the guise of child support.

“Most of the expenses [in Evangelista's list of $46,000-a-month in child care expenses] do not relate to Augie but they relate to Ms. Evangelista,” Aronson, said in opening statements yesterday.

Beslow shot down that argument in court today, citing legal documents created for Valentina that says any legal guardian can materially benefit from the provisions of her trust, saying that it’s hypocritical not to award Evangelista child support just because she may thusly benefit from it.

Staying true to her modeling roots, Evangelista was fashionably late for the second day, entering the court with powerhouse style in a white pencil skirt, slate-colored blazer, and python Christian Louboutin stilettos.

Evangelista’s lawyer, William Beslow, sought to shoot holes in Pinault’s argument that he treats Augie as well as he treats his other three children. Beslow noted that Pinault spent 260,000 euros on gifts in 2010. Only two of those gifts were for Augie, he noted, one of which Pinault cited as being from FAO Schwartz, “a piano thing”, he said.

Valentina, Pinault’s daughter with actress Salma Hayek, has been taken on a $52,000- 12-day vacation to Bora Bora and has a $12 million Los Angeles home in a trust for her.

All this comes after a thrill-rocked hearing on Thursday, in which lawyers for Evangelista claimed that Pinault had asked her to abort the baby and said that he never responded to child support claims. He insisted that he offered a counter-offer to her intial report in 2007, an offer he says went unanswered.

“I’m not going to pay money I’m not asked for,” Pinault said Thursday.

Linda Evangelista’s Lawyer Says Pinault Wanted Her to Abort Son

Linda Evangelista and her former beau Francois Henri-Pinault faced off in court in New York on Thursday afternoon in a bitter child-support dispute over how much money Evangelista will receive to take care of their 5-year-old son, Augustin.

In the first day of this explosive hearing in a Manhattan Family Court, Evangelista, 46, denied accounts that she was demanding a record-breaking $46,000 in monthly expenses from Pinault. Evangelista audibly cried out after David Aronson, Pinault’s attorney, and questioned if she was asking for that amount of money. Her team said that they had never asked for that specific amount, claiming that the media was spreading misinformation.

If the judge awards that amount -- the equivalent of $1,500 a day -- Pinault, heir to a $1.5 billion family fortune, would break New York state’s record for the biggest child support payout, a record now held by Sean “Diddy” Combs, who pays $19,000 in monthly expenses.

Evangelista, donning oversized sunglasses and python Christian Louboutin stilettos, strode into court almost 20 minutes after the hearing was scheduled to begin, barely casting a glance at her former lover.

She and her lawyer, William Beslow, asserted that, in the context of Pinault’s great wealth (he earns $5 million a year), he has paid nearly nothing to support little Augie. Her defense team claimed that Pinault asked her to terminate her pregnancy. According to her lawyers, she refused and said that she would pay child support herself.

The supermodel, whose face has graced more than 600 magazine covers, is worth about $8 million.  But she says now that her lucrative L’Oreal Paris contract has ended, the time has come for her to seek child support. She says that she first filed for child support in 2010 and then again in 2011. Both of her claims went unanswered, she said.

Pinault, after taking the stand, vehemently denied claims that he asked Evangelista to abort the baby and countered by saying he tried several times to put forth child-support plans and was met with either total unresponsiveness or merely unreasonable demands.

“I was not involved in the decision of having a baby,” he said.

Evangelista insists that she needs the money for around-the-clock care for Augie as well as a driver and armed bodyguards for her son. She’s also asking for Augie to be cared for as lavishly as Pinault treats Valentina, his daughter with his wife, actress Salma Hayek.  Pinault has a $13 million California mansion in a trust for Valentina and, according to the New York Post, Evangelista is asking for at least a country home for Augie.

Divorce lawyer Raoul Felder told ABC News that he believes Evangelista’s requests are unlikely to be fulfilled.

“It’s the triumph of illusion over reality,” he said. “That’s all this is, a fairy tale.”

“If she were married to him, that’s a whole other story,” he added.

Evangelista and Pinault dated for four months beginning at the end of 2005, and she was pregnant with Augie when Pinault began dating Hayek in 2006. Pinault and Hayek married in 2009.

Pinault says that he will not pay anything until the court renders a decision. The hearing is slated to continue through Tuesday.

Linda Evangelista Takes Salma Hayek’s Hubby to Court for Child Support

Rabbani and Solimene Photography/Getty Images for Versace for H&M(NEW YORK) -- Linda Evangelista will face off in court against Salma Hayek’s billionaire husband Francois-Henri Pinault, the father of Evangelista’s 5-year-old son, Augustin.

The supermodel is asking Pinault, heir to a $11.5 billion family estate, for a record-breaking $46,000 a month in child support. The pair will meet in Manhattan Family Court Thursday.

Evangelista dated Pinault for four months at the end of 2005 and was pregnant with “Augie” when Pinault began dating Hayek in April 2006. Pinault and Hayek have been married since 2009 and have a 4-year-old daughter, Valentina.

Evangelista, 46, says she needs the money for round-the-clock care, a driver and armed bodyguards for her son, according to the New York Daily News. “I need to protect him,” she told Love magazine in February.

When a judge questioned the supermodel’s need for full-time nannies, she responded, according to the Daily News, “When I work, it can be a 16-hour day. On days when I do not work, I am working on my image. I have to hit the gym. I have beauty appointments. I have to work toward my next job and maintaining my image, just like an athlete.”

Famed divorce lawyer Raoul Felder told ABC News that he believes Evangelista’s claims are unrealistic. “It’s the triumph of illusion over reality,” he said. “That’s all this is, a fairy tale.”

“If she were married to him, that’s a whole other story,” he added.

Felder pointed out that even billionaire businessman Ron Perelman’s ex-wife Patricia Duff, herself a millionaire, only received $12,000 a month in child support for their daughter, Caleigh.

For his part, Pinault has defended himself against the perception that he has been a deadbeat dad.

“At every possible opportunity he has participated in my family life whether in France or the United States,” he said of Augie, who, under French law, stands to inherit one-quarter of his father’s estate. “He is totally integrated within my family,” Pinault said.

Pinault, 49, is chief executive of PPR, the conglomerate that owns Yves Saint Laurent, Gucci and Bottega Veneta. Dubbed the “King of Luxury,” Pinault owns homes in Paris and Los Angeles. His family estate includes Christie’s auction house, Château-Latour vineyard in Bordeaux and French premiere league football team Stade Rennais, the Daily News reported.

The 1980s supermodel is no slouch herself. She is worth $8 million and owns a downtown Manhattan penthouse as well as an Upper East Side apartment near her son’s school, according to the Daily News.

She broke up last year with billionaire Peter Morton, the co-founder of the Hard Rock Cafe, and soon after filed her case against Pinault. Since then, Pinault has been paying an undisclosed amount in child support for Augie and financing his health care and education, the Daily News reported.

But Evangelista, who kept the identity of Augie’s father secret until she filed court papers in July, wants more. She is also demanding that Pinault provide her son a home equal to the $13 million California mansion he put in a trust for his daughter, Valentina.

Salma Hayek’s Husband Breaks Silence on Child With Linda Evangelista

Venturelli/WireImage(PARIS) -- Perhaps three isn’t a crowd for François-Henri Pinault.

Actress Salma Hayek's billionaire husband has spoken out for the first time about his child with another bold-faced name, supermodel Linda Evangelista.

“He is totally integrated within my family,” Pinault told the French edition of Elle magazine about 4-year-old Augustin. “At every possible opportunity he has participated in my family life whether in France or the United States.”

Pinault added that Augustin has a relationship with his 3-year-old half-sister, Valentina, Pinault’s daughter with Hayek.

The family tree went from complicated to contentious earlier this year when Evangelista took Pinault to court, saying he hasn’t paid her a dollar (or, as the case may be, a euro) of child support since Augustin was born. Pinault also refuted those claims to Elle, saying he’s ”recognized” Augustin as his son since the day he was born.

Salma Hayek's Husband Allegedly Fathered Child with Linda Evangelista

JACQUES DEMARTHON/AFP/Getty Images(NEW YORK) -- Linda Evangelista has a child with Salma Hayek's husband Francois-Henry Pinault, according to the New York Post. The Post claims that the French billionaire fathered the model's 4-year-old son Augustin 'Augie' James.

Evangelista went to Family Court June 30, 2011, to settle a child support agreement with Pinault.

Hayek and Pinault have a daughter together named Valentina.

No agreement between Evangelista and Pinault has been made yet.
