NYPD Police Officers Found Not Guilty of Rape

Comstock/Thinkstock(NEW YORK) -- Two New York City police officers were found not guilty of rape and burglary on Thursday.

The verdict came after a nearly two-month trial, seven days of deliberations and two years after the cops were charged with raping a drunken 27-year-old woman in her apartment.

In 2008, Kenneth Moreno, 43, and Franklin Mata, 29, assisted the woman into her apartment in the East Village after she was drunk from a night of celebrating at her going-away party with friends. The men were caught on surveillance video returning to the apartment three times.

The woman, who filed a $57 million lawsuit against the city and the officers, accused Moreno of raping her while she was hazy from drinking. Moreno admitted to laying on the woman's bed but denied raping her. Mata was accused of standing as a lookout while Moreno raped the woman.

The NYPD had suspended the officers without pay and are now considering terminating their employment for violating their duties.

The jury charged the men with three counts of official misconduct for entering the woman's apartment which could mean less than two years behind bars. Sentencing is scheduled for June 28.
