New Bedford Man Appears in Court for Murder Charge

(NEW BEDFORD, Mass.) -- On Monday morning, Thomas Gardner will appear in Fall River Superior Court to be formally arraigned for a 2011 murder, according to our ABC affiliate WLNE-TV.

Gardner, 35, has been indicted by a Bristol County Grand Jury for the murder of Michael Duarte, 36, who was beaten to death.

Duarte’s girlfriend, Sarah Varley, reported Duarte missing on the night of November 5. Duarte went to see a home for sale that was owned by Thomas Gardner. Investigators found Duarte’s dead body under the basement of Gardner’s home, located at 1058 Churchill Street.

The police were able to locate and arrest Gardner, who was driving Duarte’s car with a Lo-Jack security recovery system.
